Terms of service
Last updated: October 31, 2026
These terms are an agreement between you and Modus Venture ("we", "us"), which runs Modus Dialer. By creating an account or paying for a plan you agree to them. If you use Modus Dialer for a business, you agree on behalf of that business.
The service
Modus Dialer is a browser-based phone dialer for calling businesses and people in the United States and Canada. Each subscription includes a US phone number and a monthly allowance of calling minutes. Calls to other countries and premium-rate numbers are blocked.
Billing
- Plans are billed monthly in advance, together with $3 a month for your phone number, until you cancel.
- Minutes refresh on each billing date and don't roll over. Talk time on calls you make and callbacks you answer counts toward your minutes, rounded up to the next minute per call. Unanswered calls and voicemails left for you don't.
- When your minutes run out, calling pauses until your next billing date or until you move to a bigger plan.
- If a payment fails, calling pauses until it succeeds. If it isn't paid, the subscription ends and your number is released.
- Refunds follow our refund policy.
Your phone number
The number is assigned to you for as long as your subscription is active. When the subscription ends, the number is released and may be given to someone else. We can't transfer numbers to other providers.
Calling rules you must follow
You are responsible for every call made from your account, and for following all laws that apply to them. That includes, where they apply, the US Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the National Do-Not-Call Registry and state rules, Canada's CRTC Unsolicited Telecommunications Rules and National DNCL, and call-recording consent laws. In particular, you agree that you will not:
- call numbers on the National Do-Not-Call Registry or a company's internal do-not-call list unless the law allows it;
- call outside the hours allowed for the person you're calling (generally 8 am to 9 pm their local time);
- use prerecorded or artificial voice messages where consent is required, or send messages to people who have asked you to stop;
- hide or fake your caller ID, harass anyone, or make threatening, fraudulent or deceptive calls;
- record a call without the notice or consent the law requires (the dialer's recording switch plays a notice, but you remain responsible);
- resell access to the service or let anyone outside your business use your account.
The dialer's calling-hours check, do-not-call list and recording notice are tools to help you; they don't make your calling legal on their own.
When we can pause or close an account
We can pause calling or close an account straight away, without a refund, if we reasonably believe it's being used to break these terms or the law, if our phone carriers flag it for spam or abuse, or if it puts our service or other customers at risk. Where we can, we'll tell you why and give you a chance to respond.
Your data and leads
Leads you import stay in your browser on your own computer; we don't store or see them. Call records, voicemails and recordings are kept by our phone provider and shown to you in the app. See our privacy policy.
Service availability
We work to keep Modus Dialer running, but calling depends on your internet connection, your browser, and our phone and payment providers, so we can't promise it will always be available or free of errors. If our service is down for more than 24 hours in a row, see our refund policy.
Limits on liability
To the extent the law allows, Modus Dialer is provided "as is", and our total liability to you for any claim is limited to the amount you paid us in the 3 months before the claim. We're not liable for indirect or lost-profit damages, or for fines or claims that result from calls you make.
You agree to cover us for claims, fines and costs that arise from calls made from your account in breach of these terms or the law.
Changes and cancellation
You can cancel anytime from your account page. We may update these terms; if a change materially affects you we'll email you at least 14 days before it takes effect. If you keep using the service after that, the new terms apply.
Governing law and contact
These terms are governed by the laws of the State of Wyoming, USA. Questions: info@modusventure.com.
